In case of adoption and the adopted child has a new nationality, will the adoption automatically end?
Pursuant to the provisions in Article 25 Law on Adoption 2010, regulates on grounds for termination of adoption are as follows:
Grounds for termination of adoption
Adoption may be terminated in the following cases:
1. The adopted child is an adult and the adoptive parents voluntarily terminate the adoption;
2. The adopted child is convicted of one of the crimes of intentionally violating the life, health, dignity, and honor of the adoptive parents; mistreating or torturing adoptive parents or adoptive children with acts of destroying the adoptive parents' property;
3. The adoptive parents are convicted of one of the crimes of intentionally violating the life, health, dignity, and honor of the adopted child; mistreating and torturing adopted children;
4. Violation of provisions in Article 13 of this Law.
Accordingly, adoption may be terminated in the following cases:
- The adopted child is an adult and the adoptive parents voluntarily terminate the adoption;
- The adopted child has been convicted of one of the crimes of intentionally violating the life, health, dignity, and honor of the adoptive parents; mistreating or torturing adoptive parents or adoptive children with acts of destroying the adoptive parents' property;
- The adoptive parents are convicted of one of the crimes of intentionally violating the life, health, dignity, and honor of the adopted child; mistreating and torturing adopted children;
- Violation of the following regulations:
+ Taking advantage of child adoption for personal gain, labor exploitation, and sexual abuse; Kidnapping, trafficking of children.
+ Forging documents to resolve adoptions.
+ Discrimination between biological children and adopted children.
+ Taking advantage of child adoption to violate population laws.
+ Taking advantage of adopting children of war invalids, people with meritorious services to the revolution, and people of ethnic minorities to enjoy preferential regimes and policies of the State.
+ Grandparents adopt their grandchildren or siblings adopt each other.
+ Taking advantage of adoption to violate the law, customs, ethics, and good cultural traditions of the nation.
Thus, the case of an adopted child having a new nationality does not fall under one of the above grounds. Therefore, the adoption will not automatically be terminated.
