Are Investment License and Investment Registration Certificates the same?
Since 1987, the Law on Foreign Investment in Vietnam was established with regulations on Investment Licenses, in the Law on Investment 2005, there were regulations on Investment Certificates and later when the Law on Investment 2014 was issued, There are specific regulations on Investment Registration Certificates.
Accordingly, only with the Law on Investment 2014 will the Investment Registration Certificate be clearly defined. Basically, the Investment Registration Certificate is a paper or electronic document recording the registration information of the investor. investment in investment projects and currently the Law on Investment 2020 is also inheriting this regulation.
Based on clause 1, Article 77 of Law on Investment No. 61/2020/QH14, it is stated that the investor has been granted an Investment License/Investment Incentive Certificate/Investment Certificate/Investment Registration Certificate before the effective date of this Law (January 1, 2021), may carry out investment projects according to the Investment License or Investment Incentive Certificate or Investment Certificate or Investment Registration Certificate that has been issued.
In addition, previously, Clause 1, Article 74 of the Law on Investment 2014 also stated that investors who were granted Investment Licenses/Investment Certificates before the effective date of this Law (July 1, 2015) may Implement investment projects according to the issued Investment License or Investment Certificate. If the investor requests, the investment registration agency will issue an Investment Registration Certificate.
Thus, from the above evidence it can be seen that Investment License, Investment Certificate, Investment Registration Certificate are one.
