Are doctors allowed to sell medicine to patients at home?
According to Clause 4, Article 2 of the Law on Medical Examination and Treatment 2023, a medical examination and treatment practitioner is a person who has been granted a license to practice medical examination and treatment by a competent Vietnamese agency.
And according to Clause 1, Article 26 of the Law on Medical Examination and Treatment 2023, it is stipulated that professional positions must have a license to practice medical examination and treatment as follows:
“Professional titles must have a license to practice
1. Professional titles that require a practice license include:
a) Doctor;
b) Physician;
c) Nursing;
d) Midwifery;
d) Medical technology;
e) Clinical nutrition;
g) Outpatient emergency medical staff;
h) Clinical psychology;
i) Physician;
k) People who have traditional remedies or traditional methods of treating diseases.

Therefore, doctors are considered practitioners of medical examination and treatment.
Whether doctors have the right to sell medicine to patients at their home, according to the provisions of Clause 11, Article 7 of the Law on Medical Examination and Treatment 2023 is as follows:
“Prohibited acts in medical examination and treatment activities
...
11. Practitioners who sell drugs in any form, except in the following cases:
a) Traditional medicine doctors, traditional medicine doctors, traditional medicine doctors;
b) A person who has a family medicine recipe sells medicine according to the family medicine recipe under his or her ownership and has been registered.
…”
According to the above regulations, doctors will not have the right to sell medicine to patients at home, unless they are traditional medicine doctors, traditional medicine physicians, traditional medicine practitioners or people with traditional medicine recipes. transmitting and selling medicines according to registered family medicine recipes under their ownership.
