According to Article 331 of the 2015 Penal Code, the crime of abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals is as follows:
“The crime of abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals
1. Anyone who takes advantage of the rights to freedom of speech, freedom of the press, freedom of belief, religion, freedom of assembly, association and other democratic freedoms to infringe upon the interests of the State, the rights , legitimate interests of organizations or individuals, shall be subject to a warning, non-custodial reform for up to 03 years or imprisonment from 06 months to 03 years.
2. Committing a crime that adversely affects security, order, and social safety, shall be sentenced to imprisonment from 02 to 07 years.”
According to the above regulations, a person who fabricates slander to insult an organization's reputation on social networks (abusing freedom of speech, fabricating slander, insulting an organization's reputation on social networks) can be prosecuted for criminal liability for the crime of abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals with a penalty of warning and non-custodial reform. up to 03 years or imprisonment from 06 months to 03 years.
And in the case of a crime that negatively affects security, order, and social safety, the person may be sentenced to imprisonment from 02 to 07 years.
