Can law firms provide consulting services on establishing a company?
Whether a law firm can provide consulting services for establishing a company depends on the following: Article 22 Law on Lawyers as follows:
Scope of law practice
1. Participate in legal proceedings as a defense attorney for a detainee, a defendant, or a person protecting the rights of a victim, a civil plaintiff, a civil defendant, or a person with rights related obligations in criminal cases.
2. Participate in proceedings as a representative or protector of the legitimate rights and interests of the plaintiff, defendant, and people with related rights and obligations in civil dispute cases, marriage and family, business, commerce, labor, administration, civil claims, marriage and family, business, commerce, labor and other cases and matters according to the provisions of law the law.
3. Provide legal advice.
4. Representing clients outside of litigation to perform law-related work.
5. Provide other legal services according to the provisions of this Law.
Article 23 Law on Lawyers stipulates:
Lawyer's form of practice
Lawyers can choose one of the following two forms of practice:
1. Practicing in a law practice organization is carried out by establishing or participating in the establishment of a law practice organization; work under a labor contract for a law practice organization;
2. Practicing as an individual as prescribed in Article 49 of this Law.
Thus, lawyers can practice in a law practice organization or can be understood as a law firm. And the scope of law practice includes providing legal advice.
Accordingly, the law firm can provide consulting services for establishing a company. In fact, depending on the type and industry of business, establishing a company has quite complicated procedures. Realizing this problem, many law firms have appeared specializing in providing consulting services and more. Furthermore, it is authorized to carry out company establishment procedures.
