Do foreign-invested companies have the right to distribute pharmaceuticals in Vietnam according to current regulations?
Regarding the issue of whether foreign-invested companies have the right to distribute pharmaceuticals in Vietnam according to current regulations, Clause 3, Article 2 of Circular 34/2013/TT-BCT is as follows:
“Implement export rights, import rights, and distribution rights of foreign-invested enterprises in Vietnam
1. Enterprises with foreign investment in Vietnam may exercise the right to export goods that are not on the list of goods specified in Appendix No. 01 of this Circular.
2. Enterprises with foreign investment in Vietnam may exercise the right to import goods that are not on the list of goods specified in Appendix No. 02 of this Circular.
3. Foreign-invested enterprises in Vietnam may exercise distribution rights for goods that are not on the list of goods specified in Appendix No. 03 of this Circular.”
Compared with Appendix No. 03 issued with Circular 34/2013/TT-BCT, pharmaceuticals are on the list of goods that are not allowed to exercise distribution rights.
Therefore, foreign-invested companies do not have the right to distribute pharmaceuticals in Vietnam.
