Penalties for foreigners who make false statements to apply for VISA?
According to Clause 7,Clause 8, Article 18 of Decree No. 144/2021/ND-CP, violating regulations on exit, entry, transit, residence and travel as follows:
- Fine from 30,000,000 VND to 40,000,000 VND for one of the following acts:
+ Counterfeit passports, travel documents, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;
+ Entering or staying at an embassy, consulate, diplomatic representative agency, consular office or headquarters of an international agency or organization located in Vietnam without permission of that agency or organization;
+ Foreigners residing in areas where foreigners are prohibited from residing;
+ Vehicle owners, vehicle managers, drivers of all types of vehicles transporting people entering or exiting Vietnam illegally;
+ Organizing, brokering, assisting, instigating, harboring, concealing, creating conditions for others to leave, stay abroad, enter, stay in Vietnam or cross national borders illegally.
+ Foreigners who do not comply with the competent authority's decision to force them to leave Vietnam and continue to reside in Vietnam.
- Additional penalties:
+ Confiscate material evidence and means of administrative violations for the acts specified in Points b, c, d, Clause 3; Point a Clause 4; Point a Clause 5; Point c Clause 6; Points a and d, Clause 7 of this Article;
+ Expel foreigners who commit administrative violations specified in Clauses 1, 2, 3, 4, 5, 6 and 7 of this Article.
Thus, in case a foreigner makes a false declaration to apply for documents (VISA) to stay in Vietnam, he or she may be fined from 30,000,000 VND to 40,000,000 VND and for violating organizations, the fine will be from 60,000 VND. 000 VND to 80,000,000 VND. In addition, additional sanctions are applied such as confiscation of evidence and means of violation; or deporting foreigners.
