How many times can a foreigner's work permit be renewed?
Pursuant to Article 16 of Decree 152/2020/ND-CP regulating conditions for extending work permits, specifically as follows:
“Article 16. Eligibility requirements for renewal of a work permit
1. The remaining validity period of the work permit is at least 5 days but not exceeding 45 days.
2. The competent authority grants an acceptance of demand for foreign workers as prescribed in Article 4 or 5 hereof.
3. A document supporting that the foreign worker will continues in employment with the employer as specified in the concerned work permit is available.”
Accordingly, to extend a work permit, the following conditions must be met:
- The issued work permit is valid for at least 05 days but not more than 45 days.
- Approved by the competent authority for the need to employ foreign workers.
- Documents proving that the foreign worker continues to work for the employer according to the contents of the issued work permit.
Pursuant to Article 19 of Decree 152/2020/ND-CP regulating the term of extended work permits, specifically as follows:
“Article 19. Validity period of a renewed work permit
The term of the work permit is extended according to the term of one of the cases specified in Article 10 of this Decree but can only be extended once for a maximum period of 02 years.”
In conclusion, work permits can only be renewed once for a maximum period of 2 years.
