1. How to apply for a license to sell alcohol for on-site consumption?
According to Clause 5, Article 3 of Decree 105/2017/ND-CP, selling alcohol for on-site consumption is the activity of selling alcohol directly to buyers for consumption at the sales location.
Previously, Article 4 of Decree 105 stipulated that traders selling alcohol for on-site consumption must have a license according to the provisions of this Decree.
However, from March 22, 2020, traders selling alcohol with an alcohol content of 5.5 degrees or more for on-site consumption, traders selling alcohol with an alcohol content of less than 5.5 degreesNo need to apply for a license to sell alcohol for on-premise consumption, this procedure has also been abolished according to the provisions of Decree 17 of 2020.
Currently, merchants sell alcohol for on-site consumptionJust register with the Department of Economics or the Department of Economics and Infrastructure at the district level.
In addition, in the process of selling alcohol for on-site consumption, traders must comply with regulations on fire prevention and fighting and environmental protection according to the provisions of law.

3. Conditions for selling alcohol for on-site consumption
Conditions for selling alcohol for on-site consumption specified in Article 14 of Decree 105/2017, amended by Decree 17/2020 include:
- Is an enterprise, cooperative, cooperative union or business household established according to the provisions of law.
- Have the legal right to use a fixed business location, clear address and register to sell alcohol for on-site consumption with the Department of Economics or the Department of Economic and Infrastructure at the district level where the trader locates the business.
- Alcohol for on-site consumption must be provided by a trader with a License to produce, distribute, wholesale or retail alcohol.
- In case a trader produces their own alcohol for on-site consumption, they must have a License for industrial alcohol production or a License for manual alcohol production for business purposes according to regulations.
4. Rights and obligations of traders selling alcohol for on-site consumption
Traders selling alcohol for on-site consumption have the rights and obligations specified in Clause 5, Article 18 of Decree 105/2017, amended by Decree 17/2020 as follows:
- Buy wine from domestic wine producers, distributors, wine wholesalers, and wine retailers;
- Selling wine directly to buyers for consumption at merchants' business locations.
