Permanent residence registration in Vietnam for Vietnamese citizens residing abroad
1. Legal Basis:
- Pursuant to the Law on Residence 2006, as amended and supplemented in 2013;
- Pursuant to the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014;
- Pursuant to Decree No. 136/2007/ND-CP;
- Pursuant to Joint Circular No. 05/2009.
2. Procedures, Requirements, and Conditions for Re-registering Permanent Residence in Vietnam for Overseas Vietnamese Citizens:
2.1. Procedure:
Step 1: Prepare Required Documents
Case 1: For overseas Vietnamese citizens whose business registration certificate or equivalent legal documents issued by foreign authorities have been revoked and subsequently annulled by a competent authority, the applicant must submit a request for the restoration of the tax code within 10 days from the date of receiving the annulment notice.
Required documents include:
- Application for permanent residence in Vietnam (Form TT01, issued with Joint Circular No. 01/2012/TTLT/BCA-BNG, dated January 3, 2012);
- Certified copy of the foreign passport or international travel document or permanent residence permit issued by foreign authorities (may be a photocopy accompanied by the original for verification);
- Certified copy or photocopy with original for comparison of documents proving Vietnamese nationality as per Article 11 of the Vietnamese Nationality Law;
- Two recent 4x6 cm color photographs taken within the last year, with white background, straight posture, no tinted glasses (one affixed to the application, one separate); one 4x6 cm photo of a child if included in the application;
- Certified copy or photocopy with original for comparison of documents proving legal residence in Vietnam, including:
+ Certificate of house ownership or equivalent legal documents issued by competent authorities;
+ Land use rights documents;
+ Construction permit (if required);
+ Contract for purchase of state-owned housing or documents on privatization;
+ Contract for purchase of housing or documents proving delivery of housing from real estate enterprises;
+ Documents on purchase, sale, donation, exchange, inheritance of housing with notarization or certification by the People's Committee (at commune level);
+ Documents from courts or competent administrative authorities confirming house ownership;
+ Documents from the People's Committee at commune level confirming undisputed house ownership or land use rights;
+ Documents proving registration of boats, ships, or other vehicles used as residences.
For overseas Vietnamese citizens residing in Vietnam with legal accommodation through lease, borrowing, or staying with organizations or individuals, a written consent from the host organization or individual agreeing to register permanent residence at the provided accommodation, certified by the commune-level People's Committee (Form TT02), along with one of the following documents:
- Lease, borrowing, or accommodation agreement (if from an individual, must be notarized or certified by the commune-level People's Committee);
- Documents proving or certifying family relationships as per Vietnamese law.
For registration in centrally governed cities, Hanoi, or religious establishments for religious activities, additional documents are required to prove eligibility, such as:
- Documents proving eligibility for permanent residence in centrally governed cities as per Article 20 of the Residence Law;
- Documents proving religious status and consent from religious leaders for religious activities.
- Number of application dossiers required: 02 (two) sets.
Step 2: Submit Documents
Submit the application at the reception and results return section of the Immigration Department - Ministry of Public Security.
Step 3: Receive Results
Present the receipt to the officer for verification. If approved, the residence notice will be issued.
Processing time: Monday to Saturday (excluding Sundays and public holidays).
2.2. Requirements and Conditions:
+ Overseas Vietnamese citizens must possess valid foreign passports or international travel documents or permanent residence permits issued by foreign authorities;
+ Must not fall under the categories restricted from entry or exit as per Vietnamese law;
+ Must have legal accommodation in Vietnam;
+ If registering in centrally governed cities or religious establishments, additional documents proving eligibility are required.
