Procedures for applying for an air transport business license.
1. Conditions for air transport business:
– According to the provisions of Article 5 of Decree 92/2016/ND-CP, to operate air transport business, businesses need to ensure compliance with the following specific conditions:
+ Air transport business activities must be consistent with air transport development planning.
+ The air transport business must ensure that it meets the conditions of the plan to ensure the availability of aircraft for operation, organizational structure, capital, business plan and product development strategy according to the provisions of law. the law.
+ Air transport businesses must be granted an air transport business license by the Ministry of Transport after receiving permission from the Prime Minister.
+ The regulations on transportation activities according to the provisions of this Decree do not apply to the field of training and professional training of flight crew members and instructors.
– In addition, businesses need to ensure the following conditions for flight organization:
+ Air transport enterprises must ensure that they have an organizational apparatus to implement the safety and security management system, aircraft operations, aircraft maintenance, flight training, and ground operations; product development, marketing and sales of air transportation services and general aviation services in accordance with the provisions of law on civil aviation; financial payment system.
+ The person appointed to hold a position in charge of the safety and security management system, aircraft operations, aircraft maintenance, and flight training must have at least 03 years of continuous working experience in the designated field. Appointed, have diplomas and certificates issued or recognized according to the provisions of law on civil aviation.
+ The legal representative of the air transport enterprise must be a Vietnamese citizen.
2. Procedures for applying for an air transport business license:
2.1. Dossier to apply for an air transport business license:
The application for an air transport business license includes the following specific papers and documents:
– Written request for license according to Form No. 01 specified in the Appendix issued with this Decree;
– Original document confirming capital;
– Organizational chart of the enterprise;
– A certified copy of the appointment decision, labor contract, copies of diplomas and professional certificates of the persons in charge specified in Article 7 of this Decree;
– Principle contract or agreement on the purchase, lease purchase or lease of aircraft;
– Charter of business operations.
2.2. Procedure for applying for an air transport business license:
Applying for an air transport business license follows the following specific steps:
– Step 1: Prepare and submit application.
+ Businesses that want to apply for an air transport business license will prepare a dossier with all the papers and documents listed in the section above.
+ After fully preparing the documents, the applicant for an air transport business license or general aviation business license shall send 01 set of documents directly or through the postal system or in other appropriate forms. to the Vietnam Aviation Administration and must be responsible for the accuracy and truthfulness of the information in the dossier.
– Step 2: Appraisal of documents.
The Civil Aviation Authority of Vietnam accepts documents submitted by businesses and conducts appraisal. Within 30 days from the date of receiving complete documents as prescribed, the Vietnam Aviation Administration reports to the Ministry of Transport the appraisal results.
In case the dossier is not valid, within 03 working days from the date of receiving the dossier, the Civil Aviation Authority of Vietnam must respond in writing to the applicant and provide instructions for completing the dossier according to regulations.
– Step 3: Submit appraisal results to the Prime Minister.
+ Within 15 days from the date of receiving the appraisal results report from the Civil Aviation Authority of Vietnam, the Ministry of Transport will consider and submit it to the Prime Minister. + If the Prime Minister does not approve the appraisal results, there must be a written response to the Vietnam Aviation Administration (the document must clearly state the reason).
+ If the appraisal results are accepted, then within 10 days from the date of receiving the Ministry of Transport's Proposal, the Prime Minister will consider and allow the Ministry of Transport to issue a Transport Business License. Aviation, General Aviation Business License.
– Step 4: Issue air transport business license.
Within 05 working days from the date of receiving the Prime Minister's comments, the Ministry of Transport shall issue an air transport business license to the enterprise.
At the same time, within 05 working days from the date of issuance of the license, the air transport business must publish in 03 consecutive issues of the license the contents of the license.
