The Berne Convention for the Protection of Literary and Artistic Works (Berne Convention for the Protection of Literary and Artistic Works), referred to as the Berne Convention, was promulgated in 1886 in Berne.
The purpose of the Berne Convention is expressed in its preamble "to protect in an effective and uniform manner the rights of authors in literary and artistic works".
The Berne Convention sets out three basic principles:
- Principle of "national treatment": works originating in one of the member states must receive the same protection in a member state as works of its nationals.
- Principle of automatic protection: national treatment does not depend on any formality, in other words protection is granted automatically without reference to registration, storage or similar procedures .
- Principle of independent protection: the enjoyment and exercise of rights is independent of the protection available in the country of origin of the work.
On June 7, 2004, the President issuedDecision 332/2004/QD-CTN in 2004 on accession to the Berne Convention for the Protection of Literary and Artistic Works.
Vietnam joined the Berne Convention for the Protection of Literary and Artistic Works on October 26, 2004.
