1. What is an aircraft?
Aircraft is a device that is kept in the atmosphere by interaction with the air, including airplanes, helicopters, gliders, airships and other flying devices, except devices that are kept in the atmosphere by interaction with air reflected from the earth's surface.
2. Conditions for aircraft to be registered with Vietnamese nationality
Pursuant to the provisions of Clause 2, Article 13 of the Vietnam Civil Aviation Law, the conditions for aircraft to be registered with Vietnamese nationality are:
a) Not yet have citizenship of any country or have had foreign nationality registration deleted;
b) Have legal documents proving ownership of the aircraft; right to possess aircraft in case of leasing - buying or leasing aircraft;
c) For used aircraft, when registering nationality for the first time, they must meet the age requirements as prescribed for used aircraft at the time of import into Vietnam according to the provisions of law. the law.
d) Meet the conditions and requirements to ensure national defense and security; aviation safety, aviation security and environmental protection according to the provisions of law.
3. Cases of deletion of nationality registration
Cases of de-registration of Vietnamese nationality for aircraft are specified in Article 14 of the Vietnam Civil Aviation Law and guided in Decree No. 68/2015/ND-CP (amended in Decree No. 07/2019/ ND-CP). Specifically, those cases are:
- The aircraft is declared missing according to the provisions of law;
- The aircraft no longer meets the conditions for registration of Vietnamese nationality;
- At the request of the aircraft owner or the person requesting aircraft registration;
- At the request of the designated person in the IDERA document.
- The aircraft is so severely damaged that it is no longer capable of repair or recovery.
Cases of aircraft having their temporary registration of Vietnamese nationality removed include:
- The temporary registration period has expired according to the Certificate of temporary registration of aircraft with Vietnamese nationality;
- The aircraft is no longer in the manufacturing, assembly or testing phase in Vietnam;
- At the request of the aircraft owner or designated person in the IDERA document.
