Aircraft leased for 24 months or more must be registered with Vietnamese nationality
According to Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government regulating nationality registration and registration of rights to aircraft and aircraft owned by Vietnamese organizations and individuals, Aircraft leased - purchased or leased without a flight crew for a lease term of 24 months or more to operate in Vietnam must be registered with Vietnamese nationality. Aircraft must be registered with Vietnamese nationality within 6 months from the date of import into Vietnam.
To be registered with Vietnamese nationality, the aircraft must not yet have the nationality of any country or have its foreign nationality registration removed; have legal documents proving ownership of the aircraft, the right to possess the aircraft in case of renting - buying or leasing an aircraft; Meets the conditions and requirements for ensuring security, national defense, aviation safety, environmental protection and aircraft age (for used aircraft).
For aircraft that are in the manufacturing, assembly, and testing stages in Vietnam, do not yet have the citizenship of any country or have had their foreign nationality registration removed; have documents proving ownership or possession of aircraft... will be temporarily registered with Vietnamese nationality. At the end of the temporary registration period for Vietnamese nationality, according to the Certificate, is no longer in the manufacturing, assembly, or testing phase in Vietnam or when the aircraft owner or the person designated in the IDERA document requests, this temporary registration will be deleted.
This Decree takes effect from October 15, 2015.
