1. What is renunciation of nationality?

Pursuant to Article 1 of the 2008 Law on Vietnamese Nationality stipulates:

"Vietnamese nationality represents an individual's close relationship with the State of the Socialist Republic of Vietnam, giving rise to the rights and obligations of Vietnamese citizens towards the State and the rights and responsibilities of the State. Socialist Republic of Vietnam towards Vietnamese citizens."

2. Grounds for citizens to renounce their nationality

Clause 1 Article 27 Law on Vietnamese Nationality:

"Vietnamese citizens who apply to renounce their Vietnamese nationality to acquire foreign nationality can have their Vietnamese nationality renounced."

It can be seen that the renunciation of Vietnamese nationality comes entirely from the voluntariness of Vietnamese citizens. It is expressed in an application for the purpose of acquiring foreign nationality; or have foreign citizenship; or have Vietnamese nationality and foreign nationality at the same time. Through the above reasons, I now voluntarily renounce my Vietnamese nationality; to enjoy the benefits of the country of which they are citizens. However, not everyone with an application will be considered by the President; decided to give up Vietnamese nationality.

3. In what cases is a person applying to renounce Vietnamese nationality not allowed to renounce nationality?

A person who applies for renunciation of Vietnamese nationality may not renounce Vietnamese nationality if he/she falls into one of the following cases:

+ Owing taxes to the State or having property obligations to agencies, organizations or individuals in Vietnam;

+ Being prosecuted for criminal liability;

+ Currently serving a judgment or decision of a Vietnamese Court;

+ Currently in detention awaiting sentence execution;

+ Currently complying with the decision to apply administrative measures to send to an educational facility, medical treatment facility, or reformatory.

4. In what cases are citizens not allowed to apply for renunciation of Vietnamese nationality?

- A person who requests to renounce Vietnamese nationality may not renounce Vietnamese nationality if doing so harms the national interests of Vietnam.

- Officials, civil servants and those serving in the Vietnamese people's armed forces are not allowed to renounce their Vietnamese nationality.
