According to the provisions of Clause 7, Article 3 of the 2014 Housing Law, social housing is understood as housing that receives State support for subjects entitled to housing support policies if they meet the conditions under prescribed in the Housing Law.
Specifically, beneficiaries of social housing support policies include:
- People with meritorious services to the revolution according to the provisions of law on preferential treatment for people with meritorious services to the revolution.
– Poor and near-poor households in rural areas.
– Households in rural areas frequently affected by natural disasters and climate change.
– Low-income people, poor and near-poor households in urban areas.
– Workers working at enterprises inside and outside the industrial park.
– Officers, professional non-commissioned officers, technical non-commissioned officers, professional soldiers, workers in agencies and units of the people's police and people's army.
– Cadres, civil servants and public employees according to the provisions of law on cadres, civil servants and public employees.
– Subjects who have returned official housing: Tenants of official housing who are no longer eligible to rent housing or move to another place or who violate regulations on housing management and use If the housing is subject to repossession, the official housing must be returned to the State.
– Households and individuals are subject to land recovery and must clear and demolish houses according to the provisions of law but have not been compensated by the State with housing or residential land.
– Students of public ethnic boarding schools can use housing during their studies; students at academies, universities, colleges, and vocational schools.
2. Conditions to enjoy social housing support policies:
* For those who have contributed to the revolution; low-income people, poor and near-poor households in urban areas; workers working at enterprises inside and outside the industrial park; officers, professional non-commissioned officers, technical non-commissioned officers, professional soldiers, workers in agencies and units of the people's police and people's army; officials and civil servants; The subject has returned the official residence; Individuals and households subject to land recovery:
– Do not have a house of their own, have not been able to buy, rent or lease-purchase social housing, and have not received any form of housing or land support policy at the place of living or studying.
In case of owning a house, the average housing area per capita in the household must be lower than the minimum housing area prescribed by the Government from time to time and each region.
– Make sure to have permanent residence registration in the province or centrally run city where social housing is located. If you do not have permanent residence registration, you must register for temporary residence for a period of 01 years or more in the province or city where social housing is located.
– For low-income people, poor and near-poor households in urban areas; workers working at enterprises inside and outside the industrial park; Officers, professional non-commissioned officers, technical non-commissioned officers, professional soldiers, workers in agencies and units of the people's police and people's army; Officials, civil servants, and public employees: These subjects are not required to pay regular income tax according to personal income tax regulations.
- In case the subject is a poor or near-poor household, it must be in the poor or near-poor category according to the Prime Minister's regulations.

* Subjects who have contributed to the revolution; poor and near-poor households in rural areas; Households in rural areas in areas frequently affected by natural disasters and climate change: must meet the conditions specified in the housing authority's decision approving the corresponding target housing program. competent country.
* In cases where subjects in Clauses 1,4,5,6,7, Article 49 of the 2014 Housing Law build new or renovate or repair houses for residential purposes, they will be supported with preferential loans from the State through customs clearance from the main bank. Social policies, credit institutions must meet:
– Have residential land but do not have a house or have a house but the house is damaged or dilapidated.
– In localities where there is residential land or housing that needs to be newly built or renovated or repaired: permanent residence registration is required.
3. Can social housing be resold? How long does it take to sell social housing?
Article 19 of Decree 100/2015/ND-CP stipulates conditions for reselling social housing as follows:
– Subjects buying back social housing:
Social housing must be resold to the right subjects and under the conditions prescribed in Article 49 and Article 51 of the 2014 Housing Law.
– Each individual and household can only receive social housing support once according to the law.
– The sale of social housing invested with the state budget shall comply with the provisions of law on management and use of state-owned housing.
– For a minimum period of 05 years, buyers of social housing are not allowed to mortgage (except in the case of mortgaging with a bank to borrow money to buy or rent to buy that apartment) and are not allowed to transfer the house below. in all forms, from the time of paying in full for the purchase or lease-purchase of housing according to the contract signed with the seller or lessor.
At the same time, it is only allowed to resell, mortgage or lease after being granted a Certificate of land use rights, ownership of houses and other assets attached to land according to the provisions of land law.
– The seller of an apartment must pay to the State 50% of the value of the land use fee allocated to that apartment; In case of selling adjacent low-rise social housing, 100% of the land use fee must be paid, calculated according to the land price issued by the Provincial People's Committee at the time of selling the house, from the time the buyer, lease-purchase of the house Social housing is allowed to sell social housing to those in need.
Note: If the 5-year period as prescribed above from the time of paying off the purchase or lease-purchase of social housing has not been completed, the buyer or lease-purchaser wishes to resell the social housing and can only sell it to the following subjects: The State in the case of renting and purchasing social housing invested by the State. As for the case of buying or renting social housing that is invested and built with non-budget capital sources, it is sold to the construction investor or sold to the person who is allowed to buy, rent and buy social housing according to regulations. specified in Article 49 of the 2014 Housing Law.
The maximum selling price is set equal to the selling price of social housing of the same type at the same location and time of sale, and personal income tax is not required.
– In case the social housing project is only for rent, the investor will only be allowed to sell for a minimum period of 10 years.
– In case of buying or renting individual social housing invested and built by households or individuals, land use rights will be transferred in accordance with the provisions of land law.
– In each province and city, the purchase and sale of social housing will be considered in order of priority, ensuring that it is suitable for the socio-economic situation and conditions of each locality.
Thus, in the case of social housing, the user can still sell it and cannot transfer it for a minimum period of 05 years from the time the purchase price is paid in full and can only be resold after being granted a Certificate of Land Use Rights.
