Procedures for issuance of certificates of production of gold jewelry and fine arts
1. Dossier Components
Originals or copies issued from the master register, or certified true copies in accordance with legal regulations, or copies presented together with the originals for comparison, of the following documents:
- Application form for the issuance of a Certificate of Eligibility for Jewelry and Fine Art Gold Production;
- Enterprise Registration Certificate and documents proving that the enterprise has registered jewelry and fine art gold production activities in accordance with the law;
- Documents or materials evidencing the lawful ownership or use rights of the production premises;
- A declaration of physical facilities and equipment used for jewelry and fine art gold production activities;
- A projected plan for implementing the legal regulations on quality management of jewelry and fine art gold products circulated on the market, including compliance with regulations on the declaration of applicable standards and labeling of jewelry and fine art gold products.
2. Procedure for Applying for the Certificate of Eligibility for Jewelry and Fine Art Gold Production
Step 1:
The enterprise shall submit the application dossier to the provincial branch of the State Bank of Vietnam where the enterprise’s head office is located.
Step 2:
The State Bank’s provincial branch shall conduct an on-site inspection of the enterprise’s physical facilities and equipment used for jewelry and fine art gold production.
Step 3:
Based on the applicable conditions, the submitted dossier, procedural requirements, and the results of the on-site inspection of the physical facilities and production equipment, within 30 working days from the date of receipt of a complete and valid application, the State Bank’s provincial branch shall consider and issue, or refuse to issue, the Certificate of Eligibility for Jewelry and Fine Art Gold Production.
In addition, the applicant may choose one of the following submission methods:
- Direct submission (in person);
- Via postal service.
3. Responsibilities of Enterprises Engaged in Jewelry and Fine Art Gold Production
Pursuant to Article 6 of Decree No. 24/2012/NĐ-CP, enterprises engaged in the production of jewelry and fine art gold shall have the following responsibilities:
- To affix identification marks and gold content on products; to declare applicable standards and the weight of products in accordance with the law; and to be legally responsible for the declared standards and weight of products manufactured by the enterprise.
- To bear legal responsibility for the declared standards and weight of products processed by other entities on behalf of the enterprise.
- To comply with legal regulations on accounting regimes, and the preparation and use of invoices and accounting documents.
- To establish measures ensuring safety in production and business activities, environmental protection, and fire and explosion prevention.
- To maintain the conditions stipulated in Clause 1, Article 5 of Decree No. 24/2012/NĐ-CP.
- To comply with all provisions of Decree No. 24/2012/NĐ-CP and other relevant legal regulations.
