Choose your child's nationality when the parents have different nationalities
Dear Truong Quyen Law Office - Davilaw Branch, my husband has foreign nationality but lived and worked in Australia for about 3 years. We have a certificate of registration in the Netherlands. I went to the Netherlands for 3 months on a visitor visa. I returned to Vietnam and gave birth (the baby is now nearly 1 month old).
So let me ask: Can my child be born in Vietnam with foreign nationality according to my husband? What do the documents include?
According to the Clause 2, Article 16 of the 2008 Law on Vietnamese Nationality:
"2. A child either of whose parents is a Vietnamese citizen at the time of his/her birth and the other is a foreign national has the Vietnamese nationality if so agreed in writing by his/her parents at the time of birth registration. In case a child is born in the Vietnamese territory but his/her parents fail to reach an agreement on the selection of his/her nationality, the child has Vietnamese nationality."
Thus, because you and your husband have different nationalities, you and your husband can agree to choose the nationality for your child to be Vietnamese or foreign.
