Do stateless people residing in Vietnam have the right to adopt children?
According to Clause 4 Article 28 Law on Adoption 2010, there are regulations on adoption cases involving foreign elements, including foreigners permanently residing in Vietnam adopting children in Vietnam.
According to Clause 1 Article 41 Law on Adoption 2010 has the following provisions:
Foreigners permanently residing in Vietnam adopt children
1. The provisions of Articles 14, 15, 16, 17, 18, 21, 23, 24, 25, 26 and 27 of this Law apply to foreigners permanently residing in Vietnam who adopt children in Vietnam .

Accordingly, the conditions for adoptees specified in Articles 14 of this Law apply to foreigners permanently residing in Vietnam adopting children in Vietnam.

Conditions for adopters
1. The adoptive person must meet the following conditions:
a) Have full civil act capacity;
b) 20 years or more older than the adopted child;
c) Have health, economic, and accommodation conditions to ensure the care, upbringing, and education of adopted children;
d) Have good moral character.
2. The following people are not allowed to adopt children:
a) Some rights of parents towards minor children are being restricted;
b) Currently serving an administrative handling decision at an educational facility or medical treatment facility;
c) Currently serving a prison sentence;
d) The criminal record for one of the crimes of intentionally violating the life, health, dignity or honor of another person has not been erased; mistreating or torturing grandparents, parents, spouses, children, grandchildren, or people who have contributed to raising them; luring, forcing or harboring minors to violate the law; buying, selling, exchanging, and appropriating children.
3. In case a stepfather adopts his wife's stepchild, a stepmother adopts her husband's stepchild, or a biological aunt, uncle, or aunt adopts a grandchild, the provisions at Points b and c do not apply. Clause 1 of this article.
Currently, there is no regulation that stateless people residing in Vietnam do not have the right to adopt children in Vietnam.
Thus, if a stateless person residing in Vietnam fully meets the above conditions, he or she has the right to adopt children in Vietnam.
