How long is an investment license revoked after inactivity?

Based on Article 48 of Investment regulates on revocation of investment licenses are as follows:

"Article 48. Termination of investment project operations

1. Investors terminate investment activities and investment projects in the following cases:

a) The investor decides to terminate the operation of the investment project;

b) According to the conditions for termination of operations specified in the contract and charter of the enterprise;

c) Expiration of the investment project's operating term.

2. The investment registration agency terminates or partially terminates the investment project's activities in the following cases:

a) The investment project falls into one of the cases specified in Clauses 2 and 3, Article 47 of this Law and the investor is unable to overcome the conditions of cessation of operations;

b) The investor is not allowed to continue using the investment location and does not carry out procedures to adjust the investment location within 06 months from the date of discontinuance of use of the investment location, except for cases specified in Clause 1 of this Article. specified in Point d of this Clause;

c) The investment project has stopped operating and at the end of 12 months from the date of shutdown, the investment registration agency cannot contact the investor or the investor's legal representative;

d) Investment projects subject to land recovery due to failure to put land into use or delay in putting land into use according to the provisions of land law;

d) The investor does not deposit or does not have a guarantee for deposit obligations according to the provisions of law for investment projects subject to investment project implementation guarantee;

e) Investors carry out investment activities on the basis of fake civil transactions according to the provisions of civil law;

g) According to the judgment, decision of the Court, arbitration award.

3. For investment projects subject to investment policy approval, the investment registration agency terminates the operation of the investment project after obtaining the opinion of the investment policy approval agency.

4. Investors themselves liquidate investment projects according to the provisions of law on asset liquidation when the investment project terminates operations, except for the cases specified in Clause 5 of this Article.

5. Handling of land use rights and assets attached to land upon termination of investment project operations shall comply with the provisions of land law and other relevant laws.

6. The investment registration agency decides to revoke the Investment Registration Certificate in case the investment project terminates operations according to the provisions of Clause 2 of this Article, except in the case of partial termination of the project's operations. investment project."

Thus, the investment project has stopped operating and after the 12-month period from the date of shutdown, the investment registration agency cannot contact the investor or the investor's legal representative; license will be revoked.
