Procedures for granting licenses to transport dangerous goods
The order of execution
Step 1: Receive documents
Organizations and individuals wishing to transport dangerous goods by motor vehicle by road, railway, or inland waterway shall prepare documents according to regulations and send documents by post or submit directly to the office. headquarters or through the Electronic Information Portal of the Department of Standards, Metrology and Quality of the province or centrally run city where organizations and individuals register their businesses, specifically:
- In case of submitting the application directly at the headquarters of the Department of Standards, Metrology and Quality, the prescribed documents have not been authenticated from the original, the organization or individual must present the original for comparison.
- In case the application is sent by post or prescribed documents, the organization or individual must submit a certified copy of the original.
- In case of submitting the application through the electronic information portal of the Department of Standards, Metrology and Quality, follow the written instructions on handling online administrative procedures at the locality.
Time to receive applications: Morning from 08:00 to 12:00 and afternoon from 13:00 to 17:00 on working days of the week (except Saturdays, Sundays and holidays).
Step 2: Processing documents
The Department of Standards, Metrology and Quality receives applications, reviews and appraises according to regulations:
- In case the dossier is not valid or the dossier is complete but the content is not valid, the Department of Standards, Metrology and Quality shall notify by email or in writing the organization or individual requesting the supplement. Supplement documents according to regulations.
After 30 (thirty) days from the date of notification requesting organizations and individuals to supplement documents but not receiving a written explanation of the reason for not being able to supplement documents according to regulations, the Department of Standards and Metrology Quality shall issue a written notice of refusal to issue a Dangerous Goods Transport License and clearly state the reason.
- In case the dossier is complete and valid, the Department of Standards, Metrology and Quality will appraise the dossier and issue a Dangerous Goods Transport License to the organization or individual.
- In case the dossier requesting the transportation of dangerous goods has a quantity larger than the level specified in column 7, Appendix 1 regarding the volume threshold, it is necessary to develop an emergency response plan issued together with Circular No. 44/2012/ TT-BCT dated December 28, 2012 of the Ministry of Industry and Trade stipulates the List of dangerous industrial goods that must be packaged during transportation and transportation of dangerous industrial goods by road and rail motor vehicles. and inland waterways, the Department of Standards, Metrology and Quality needs to organize an actual appraisal at the headquarters or warehouse or gathering yard of organizations and individuals.
+ For the actual appraisal, experts are used and an appraisal team is established to perform. The appraisal team is established by the decision of the Director of the Department of Standards, Metrology and Quality.
+ After completing the actual appraisal, the Appraisal Team must prepare an actual appraisal record, which must clearly conclude that the application for a Dangerous Goods Transport License is in accordance with or not in accordance with the regulations and Recommend whether or not to grant a Dangerous Goods Transport License to organizations or individuals or clearly state the contents that require organizations or individuals to overcome.
+ In case an organization or individual does not have to take corrective action to complete the application for a Dangerous Goods Transport License, the Department of Standards, Metrology and Quality is responsible for issuing a Dangerous Goods Transport License to the organization or individual. organizations and individuals.
+ In case an organization or individual must take corrective action to complete the application for a Dangerous Goods Transport License, the Department of Standards, Metrology and Quality shall organize additional appraisal of the results of corrective action. Additional appraisal is performed by the Appraisal Team. The results of additional appraisal must be made into a Minute and clearly labeled "Minute of Additional Appraisal". The content of the additional appraisal record clearly states whether the conclusion is satisfactory or unsatisfactory and the recommendation to grant or not to grant a Dangerous Goods Transport License to organizations and individuals.
After obtaining additional appraisal results, the Department of Standards, Metrology and Quality is responsible for granting or refusing to grant dangerous goods transportation licenses to organizations and individuals. In case of refusal to issue a License to transport dangerous goods, the written refusal must clearly state the reason.
Step 3: Return results
Return results directly at the headquarters of the Department of Standards, Metrology and Quality or by post.
