Procedures for returning to Vietnamese nationality for overseas Vietnamese
1. Conditions for returning to Vietnamese nationality for overseas Vietnamese
According to Article 23 of the 2008 Law on Vietnamese Nationality, for Vietnamese residing abroad who have lost Vietnamese nationality and apply to restore Vietnamese nationality, they can be restored to Vietnamese nationality, if they fall into one of the following cases:
a/ Having applied for permission to return to Vietnam;
b/ His/her spouse, a natural parent or a natural offspring is a Vietnamese citizen;
c/ Having made meritorious contributions to Vietnam’s national construction and defense;
d/ Being helpful to the State of the Socialist Republic of Vietnam;
e/ Conducting investment activities in Vietnam;
f/ Having renounced Vietnamese nationality for acquisition of a foreign nationality but failing to obtain permission to acquire the foreign nationality.
2. Procedures for returning to Vietnamese nationality for overseas Vietnamese
2.1 Prepare documents
The application to restore Vietnamese nationality includes the following documents:
a/ An application for Vietnamese nationality;
b/ A copy of the birth certificate, passport or other substitute papers;
c/ A curriculum vitae;
d/ A judicial record issued by a competent Vietnamese authority for the period the applicant resides in Vietnam and a judicial record issued by a competent foreign authority for the period the applicant resides in the foreign country. Judicial records must be issued within 90 days before the date of filing the dossier;
e/ Papers proving his/her Vietnamese language skills;
f/ Papers proving his/her place and period of residence in Vietnam;
g/ Papers proving his/her ability to make livelihood in Vietnam.
- Documents proving eligibility to regain Vietnamese nationality as prescribed in Clause 1, Article 23 of the 2008 Law on Vietnamese Nationality, including:
+ Documents proving that the person applying to return to Vietnamese nationality has a spouse, biological father, biological mother or biological child who is a Vietnamese citizen;
+ Documents proving that the person applying to return to Vietnamese nationality has made special contributions to the cause of building and protecting the Vietnamese Fatherland or that returning to Vietnamese nationality is beneficial to the State of the Social Republic Vietnameseism;
+ Documents proving investment in Vietnam;
+ In case a person applies to return to Vietnamese nationality because they have renounced Vietnamese nationality to acquire foreign nationality, but are not allowed to acquire foreign nationality, they must have documents issued by a foreign competent authority to confirm. clearly understand the reason for not being allowed to acquire foreign nationality.
In cases where foreign citizenship is not granted due to the person's subjective fault, there must be a written guarantee from one of the parents, spouse, child or citizen brother or sister. Vietnam is permanently residing in Vietnam, accompanied by an application from that person voluntarily to reside in Vietnam.
2.2 Agency receiving documents
People who wish to obtain Vietnamese nationality submit their applications directly to the Receiving and Returning Results Department of the Department of Justice of their place of residence.
The receiving and returning results department of the Department of Justice receives the dossier and checks the validity and completeness of the documents included in the dossier:
- In case the dossier is valid and complete according to regulations, a dossier receipt will be issued;
- In case the dossier is incomplete or invalid, the official assigned to receive it will give written instructions to the applicant to supplement and complete the dossier according to regulations.
