The order of execution

- Organizations and individuals wishing to establish a facility submit 01 set of application documents for the first issuance of a Certificate of registration to establish a facility providing domestic violence prevention and control services to a specialized agency. on culture, sports and tourism of the Provincial People's Committee (Department of Culture, Sports and Tourism/Department of Culture and Sports of the province or city) where the headquarters is located.

- In case the application is invalid, within 05 working days from the date of receipt, the receiving agency shall notify the applicant in writing to complete it;

- Within 10 working days from the date of receiving a valid application, the agency receiving the application shall issue the first certificate to the facility providing domestic violence prevention and control services according to Form No. 17. of the Appendix issued with Decree No. 76/2023/ND-CP (Decree 76).

In case of refusal to issue a certificate, a written response must be provided clearly stating the reason.

Requirements and conditions

a) Conditions for the head of the facility

- Have good health as concluded by a competent medical facility according to the provisions of law on health examination.

- Have not been prosecuted for criminal liability or have not been sanctioned for administrative violations in the field of domestic violence prevention and control.

- Degree from university or higher in major, industry group, training field related to the service registered to participate in providing is specified as follows:

+ For establishments providing consulting services on domestic violence prevention and control: The head of the establishment has a university degree or higher in teacher training; health industry; psychology; law ; sociology; community service;

+ For establishments providing shelter services for people suffering from domestic violence: The head of the establishment has a university degree or higher;

+ For establishments providing educational services and supporting the conversion of domestic violence behavior: The head of the establishment has a university degree or higher in teacher training; health industry; psychology; the law; sociology; community service;

+ For facilities providing health care and mental illness prevention services for people suffering from domestic violence: The head of the facility has a university degree or higher in teacher training; health industry; psychology; sociology; community service;

+ For establishments providing other services related to domestic violence prevention and control: The head of the establishment has a university degree or higher in the industry, industry group, or field appropriate to the service provided.

- In case an establishment registers to provide many operational services specified in Clause 1, Article 40 of the Law on Domestic Violence Prevention and Control, the head must meet health requirements and must not be prosecuted for criminal liability. or have not been sanctioned for administrative violations in the field of domestic violence prevention and control and at least one of the qualifications specified above.

b) Requirements on facilities and location for establishments providing shelter or providing educational services and support for conversion of domestic violence behavior

- Facility requirements

+ Facilities providing shelter for people suffering from domestic violence must meet minimum needs such as beds, mats, blankets, mosquito nets, lighting, cooling fans, telephones, closed toilets, Doors have locks and other requirements according to the provisions of law on construction, security and order;

+ Establishments providing educational services and behavioral change support must have a place to provide hygienic services, ensure safety according to the provisions of law on construction, fire prevention and fighting, and have equipment. compatible with the service provided. -

Location requirements: The facility providing shelter or providing educational services and support for conversion of acts of domestic violence has a headquarters of operations or transactions. The place of operation or transaction must match the certificate of establishment registration.
