What is innovation transfer?

Transfer of initiatives is explained in Clause 2, Article 2 of the accompanying Initiative CharterDecree 13/2012/ND-CP Transferring an initiative is the transfer of all knowledge and information about the initiative so that the transferee can apply the initiative.

Does the investor who creates the initiative have the right to transfer the initiative to another organization? According to the provisions of Point b, Clause 1, Article 9 of the Charter of the Initiative, issued herewith.Decree 13/2012/ND-CP as follows:

The rights of the investor who creates the initiative, the author of the initiative and the person participating in the organization applying the initiative for the first time

1. For recognized initiatives, the investor who created the initiative has the following rights:

a) Apply initiatives;

b) Transfer initiatives to other organizations and individuals to apply according to the provisions of law.

2. For recognized initiatives, the author of the initiative has the following rights:

a) Be recognized as the author of the initiative in the Certificate of Initiative and be named the author of the initiative when the initiative is disseminated and introduced;

b) Receive remuneration as prescribed in Article 10;

c) Enjoy other incentive regimes according to the provisions of law on emulation, commendation and law on science and technology;

d) Apply and transfer initiatives to other organizations and individuals, except in cases where the initiative is subject to the intellectual property rights of the investor who created the initiative and in cases between the author of the initiative and the investor. Privately creates initiatives with other agreements;

d) The rights specified in Clause 1 of this Article, in case the author of the initiative is also the investor who created the initiative.

Thus, according to the above regulations, the investor who creates the initiative has the right to transfer the initiative to another organization according to the provisions of law.
