Do I need a certificate of eligibility to act as an agent to do retail gasoline and oil business under the franchise method?
Based on Article 22 Decree 83/2014/ND-CP, as amended by clause 17 of Article 1 Decree 95/2021/ND-CP Regarding conditions for traders receiving petroleum retail franchises:
Conditions for traders receiving petroleum retail franchises
Traders that meet all of the following conditions are eligible to become petrol and oil retail franchisees (hereinafter referred to as franchisees):
1. The enterprise is established according to the provisions of law, and in the Certificate of Business Registration there is registration for petroleum business.
2. Own or lease a petrol and oil retail store with a lease term of five (05) years or more and be granted a Certificate of eligibility for petrol and oil retail according to the provisions of Article 25 of this Decree.
3. Managers and direct sales staff must be trained and have training certificates and professional training in fire prevention, fire fighting and environmental protection according to current law provisions. .
Thus, in order to be a gasoline and oil retail franchisee, one of the conditions a trader must meet is:
Having a petroleum retail store owned or leased with a lease term of five (05) years or more shall be granted a Certificate of eligibility for gasoline retail according to the provisions of Article 25 of this Decree.
In other words, doing gasoline retail business under the franchise method does not require a certificate of eligibility to act as an agent.
