When participating in unemployment insurance, can employees accumulate unemployment insurance payment time?
Based on Article 45 of the Employment Law 2013 Regulations on unemployment insurance payment period are as follows:
- The period of unemployment insurance payment to be considered for unemployment insurance benefits is the total period of continuous or discontinuous unemployment insurance contributions accumulated from the start of unemployment insurance payment until the employee terminates the labor contract or work contract according to the provisions of law without receiving unemployment benefits.
- After ending unemployment benefits, the employee's previous period of unemployment insurance payment is not counted to receive unemployment benefits for the next time. The unemployment insurance payment period for the next unemployment insurance benefit is calculated again from the beginning, except in the case of termination of unemployment benefits as prescribed in Points b, c, h, l, m and n of Clause 1. 3 Article 53 of this Law.
- The time the employee pays unemployment insurance is not counted to receive job loss benefits or severance pay according to the provisions of the labor law and the law on public employees.
Thus, the time of paying unemployment insurance to enjoy unemployment insurance is calculated as the total time of paying unemployment insurance continuously or intermittently, accumulated from the time of starting to pay unemployment insurance until the person The employee terminates the labor contract or working contract according to the provisions of law without receiving unemployment benefits. In short, workers can accumulate time participating in unemployment insurance.
