Are female workers who have abortions covered by health insurance?
1. Is abortion covered by health insurance?
According to Article 21 Law on Health Insurance, health insurance participants will be paid by the health insurance fund according to the benefit ratio for the costs of medical examination, treatment, rehabilitation, periodic prenatal examination, and childbirth; Transporting patients from district level to higher level with some special subjects in emergency or inpatient treatment who must be transferred to professional and technical level.
However, the health insurance fund will only pay benefits for medical abortion cases, what about the case voluntary abortion will not be covered by health insurance pay. Because abortion is one of the cases not covered by health insurance as prescribed in Article 23 Law on Health Insurance include:
- Medical examination and treatment costs that have been paid by the state budget.
- Nursing and convalescence costs at nursing and convalescent facilities.
- Health examination costs.
- Costs for pregnancy testing and diagnosis are not for treatment purposes.
- Expenses for using assisted reproductive technology, family planning services, abortion, except in cases where pregnancy must be terminated due to pathology of the fetus or mother.
- Cost of using cosmetic services.
- Costs for treatment of strabismus, nearsightedness and refractive errors of the eye (except for children under 6 years old).
- Costs for using replacement medical supplies including artificial limbs, artificial eyes, artificial teeth, eyeglasses, hearing aids, and mobility aids in medical examination, treatment and rehabilitation.
- Expenses for medical examination, treatment, and rehabilitation in case of disaster.
- Expenses for examination and treatment of drug addiction, alcohol addiction or other addictive substances.
- Costs for medical examination, forensic examination, and forensic psychiatric examination.
- Costs for participating in clinical trials and scientific research.
2. Is abortion covered by social insurance?
According to Article 33 Law on Social insurance, in case of pathological abortion, you will be entitled to leave to enjoy maternity benefits as prescribed by the competent medical examination and treatment facility.
This means that cases of voluntary abortion are not eligible for social insurance.
Employees who have a medical abortion are entitled to leave for the following maximum time:
- 10 days off: Abortion if the fetus is under 5 weeks old.
- 20 days off: Abortion if the fetus is 5 - under 13 weeks old.
- 40 days off: Abortion if the fetus is between 13 and under 25 weeks old.
- 50 days off: Abortion if the fetus is 25 weeks or older.
The above time off includes holidays, Tet and weekly days off.
