3. Conditions to be granted an e-commerce platform license
To meet the requirements for granting an e-commerce floor license as prescribed in Article 54 of Decree 52/2013/ND-CP (amended and supplemented by Clause 2, Article 10 and Article 11 of Decree 08/2018/ND -CP and Clause 19, Article 1 of Decree 85/2021/ND-CP), an organization or trader needs to satisfy the following conditions:
- Be a trader or organization established according to the provisions of law. This ensures that only legally recognized entities can operate in the e-commerce sector.
- There must be a project to provide e-commerce services, which must clearly state the following contents:
+ Operational organization model, including service provision activities, service promotion and marketing activities both inside and outside the online environment, as well as logistics activities for goods. - Must register to set up a website providing e-commerce services and have the registration confirmed by the Ministry of Industry and Trade according to the provisions of Articles 55 and 58 of the above Decree. This registration process ensures that organizations or traders have fully complied with the regulations and standards required to operate in the e-commerce sector.

4. Procedures for applying for an e-commerce trading floor license
Step 1: Declare information to apply for an e-commerce trading floor license
To declare documents, traders or organizations access the e-commerce trading floor registration system on the website of the Ministry of Industry and Trade at www.moit.gov.vn. After filling in all the information required by the System, the trader or organization will send the online registration dossier to the Ministry of Industry and Trade.
Step 2: Within 3 working days, the trader or organization receives results from the Ministry of Industry and Trade via the registered email address with one of the following contents:
If the account registration information is complete, the trader or organization will be granted a system login account and continue with Step 3.
If account registration is denied or additional information is requested, the trader or organization needs to re-register or supplement information as requested.
Step 3: After being granted an account to log into the system, traders or organizations log in and select the function "Register for website providing e-commerce services". Then, they declare information according to the form and attach the registration dossier as prescribed in Article 14 of this Circular.
Step 4: Within 7 working days, the trader or organization receives feedback from the Ministry of Industry and Trade via the registered email address with one of the following contents:
- Confirm the registration documents are complete and valid and request the trader or organization to proceed to Step 5.
- Notification of invalid registration documents or request for additional information. In this case, the trader or organization must return to Step 3 to re-declare or supplement information and documents as required.
Step 5: After receiving notice confirming the complete and valid application, the trader or organization sends the complete registration application (paper copy) to the Ministry of Industry and Trade (Department of E-Commerce and Digital Economy) according to the provisions of Article 14 of this Circular.
- Traders or organizations are responsible for monitoring the status of application processing via email or the system access account that has been granted to update and edit information as required.
- Within 30 working days from receipt of the notice requesting additional information in Step 4 as prescribed in Clause 2 of this Article, if the trader or organization has no response, the registration documents on the system The system will be terminated and the trader or organization must register again from the beginning.
