If a foreigner is married to a Vietnamese person and has a TT visa, if he/she wants to apply for a job in Vietnam, does he/she have to convert his TT visa to a LD visa?
As prescribed at Clause 1, Article 151 of the Labor Code:
"Article 151. Conditions for foreign workers working in Vietnam
1. Foreign workers working in Vietnam are people with foreign nationality and must meet the following conditions:
a) Be 18 years old or older and have full civil act capacity;
b) Have professional qualifications, techniques, skills, and work experience; Have good health according to regulations of the Minister of Health;
c) Not a person who is serving a sentence or has not had a criminal record erased or is being prosecuted for criminal liability according to foreign or Vietnamese law;
d) Have a work permit issued by a competent Vietnamese state agency, except for the cases specified in Article 154 of this Code.
2. The term of the labor contract for foreign workers working in Vietnam must not exceed the term of the Work Permit. When using foreign workers to work in Vietnam, the two parties can agree to enter into multiple, fixed-term labor contracts.
3. Foreign workers working in Vietnam must comply with Vietnamese labor laws and be protected by Vietnamese laws, except in the case of international treaties to which the Socialist Republic of Vietnam is a member. there are other regulations."
On the other hand, according to the provisions in Decree No. 152/2020/ND-CP In the application dossier for a work permit, only a certified copy of a passport or a valid document replacing a passport or a valid international travel document is required according to the provisions of law.
Therefore, holding a TT visa does not affect employment. It is necessary to apply for a Work Permit (if not exempted) before the foreigner works.
