Based on Point b Clause 2 Article 53 Decree No. 82/2020/ND-CP Regarding violations of regulations on organizations participating in legal aid as follows:

Violations of regulations on organizations participating in legal aid

1. Warning or fine from 1,000,000 VND to 3,000,000 VND for one of the following acts:

a) Failure to comply with regulations on statistics, reporting, preparation and storage of legal aid case records according to regulations;

b) Failure to transfer unfinished legal aid case files to the legal aid organization assigned by the Department of Justice to continue carrying out the legal aid case or failing to notify the termination of assistance provision legal according to regulations.

2. Fine from 3,000,000 VND to 5,000,000 VND for one of the following acts:

a) Erasing, altering or falsifying the content of the legal aid registration form;

b) Refusing or not continuing to provide legal aid in contravention of regulations;

c) Providing legal aid inconsistently with the registered content;

d) Provide legal aid in case of ineligibility for legal aid;

d) Disclosing information about the legal aid case and the person receiving legal aid, unless the person receiving legal aid agrees in writing or the law provides otherwise;

e) Providing legal aid in case the provision of legal aid must be stopped according to regulations;

g) Impersonating or taking advantage of legal aid activities for personal gain; causing disruption to social order and safety, adversely affecting social morality but not to the extent of criminal prosecution.

3. Fine from 5,000,000 VND to 7,000,000 VND for the act of establishing a legal aid organization in contravention of regulations.

4. Additional penalties:

a) Deprive the right to use the legal aid registration certificate from 03 months to 06 months for violations specified in Points c, dd and i, Clause 2 of this Article;

b) Confiscation of exhibits that are legal aid registration papers that have been erased or altered to falsify the content for violations specified in Point a, Clause 2 of this Article.

Thus, organizations participating in legal aid that do not continue to provide legal aid in contravention of regulations will be fined from 3,000,000 VND to 5,000,000 VND without being subject to additional penalties of Revocation of the right to use legal aid registration papers.
