I hereby declare that the above statements are true and accept responsibility before Vietnamese law for the statements in the Application.

Note:

(1) Write in capital letters (according to Passport/Replacement valid documents).

(2) Write the place name of 03 administrative levels or the name of the medical facility (if born in Vietnam) or write the name of the city and country where your birth was registered (if born abroad). For example: Phu Minh commune medical station, Soc Son district, Hanoi or Potsdam city, Germany.

(3) Write the name of the birth registration agency at three administrative levels (if registering a birth in Vietnam) or write the name of the city and country where the birth was registered (if registering a birth at an agency with foreign jurisdiction). For example: People's Committee of Dien Ngoc commune, Dien Ban district, Quang Nam province or Potsdam city government, Germany.

(4) In case you have foreign nationality, write the exact name of the country of nationality according to international phonetic transcription or Vietnamese phonetic transcription. For example: Malaysia or Malaysia; In case of having two or more nationalities, clearly state each nationality. For cases where Vietnamese nationality has been relinquished but not allowed to acquire foreign nationality, clearly state "Vietnamese nationality has been relinquished but foreign nationality cannot be acquired".

(5) Clearly state the name of the document. For example: Passport.

(6) Clearly state the reason for losing Vietnamese nationality. For example: have renounced Vietnamese citizenship.

(7) In case of applying for return/naturalization of Vietnamese nationality for a minor child to live with, write down complete information for each child.

(8) In case of returning to Vietnamese nationality, the previous Vietnamese name will be restored; In case of naturalization in Vietnam, choose the name Vietnam.

2. Who can regain Vietnamese nationality?

Pursuant to Article 23,Vietnamese Nationality Law 2008, a person who has lost Vietnamese nationality according to regulations and has an application to regain Vietnamese nationality can be restored to Vietnamese nationality, if they fall into one of the following cases:

- Please repatriate to Vietnam;

- Have a spouse, biological father, biological mother or biological child who is a Vietnamese citizen;

- Have special meritorious contributions to the cause of building and protecting the Vietnamese Fatherland;

- Beneficial for the State of the Socialist Republic of Vietnam;

- Make investments in Vietnam;

- Has renounced Vietnamese nationality to acquire foreign nationality, but is not allowed to acquire foreign nationality.

3. Can I retain my foreign citizenship?

According to Clause 5, Article 23 of the 2008 Vietnamese Nationality Law, people who can regain Vietnamese nationality must renounce their foreign nationality, except for the following people, in special cases, if permitted by the President:

a) Being the wife, husband, biological father, biological mother or biological child of a Vietnamese citizen;

b) Have special meritorious contributions to the cause of building and protecting the Vietnamese Fatherland;

c) Beneficial to the State of the Socialist Republic of Vietnam.

And according to Article 14, Decree 16/2020 of the Government, theSpecial case are specified as follows:

- Are eligible to return to Vietnamese nationality according to the provisions of the Law on Vietnamese Nationality.

- The request to retain that person's foreign nationality when returning to Vietnamese nationality is in accordance with the law of that foreign country.

- The renunciation of foreign citizenship results in that person's rights in the country of nationality being affected.

Thus, if qualified and in special cases, it is possible to submit to the President for consideration of returning Vietnamese nationality without having to renounce foreign nationality.
