Pilot a number of specific policies on investment in road construction
1. Regulations on management, operation and maintenance of road works
Pursuant to the provisions in Circular 37/2018/TT-BGTVT The management, operation and maintenance of road works are regulated as follows:
The management, exploitation and maintenance of road works must meet the following requirements: Road works, when put into operation and use, must be managed, exploited and maintained according to the provisions of law on quality management and maintenance of construction works, road traffic laws and regulations in this Circular.
Maintenance of road works must be carried out in accordance with the provisions of maintenance procedures, technical regulations and standards on road maintenance announced and applied by competent authorities. Management, operation, and maintenance procedures for road works are established in accordance with the construction parts, equipment installed in the construction, and the type of construction (road, bridge, tunnel, ferry terminal, etc.). pontoon bridges and other structures), construction grade and construction purpose.
The management, operation and maintenance of road works must ensure the maintenance of the life of the works, ensure safe and smooth traffic, safety for people and property, safety of works, rooms, Explosion-proof and environmental protection.
The management, exploitation and maintenance of the following construction items are carried out in accordance with the provisions of this Circular and relevant laws, specifically as follows:
- Civil works, urban technical infrastructure works are carried out in accordance with the provisions of law on civil works, construction material industrial works and urban technical infrastructure works;
- Power supply works and lighting systems comply with regulationsDecree No. 06/2021/ND-CP on quality management and maintenance of construction works; Traffic signals and equipment installed in the project shall comply with the provisions of Decree No. 06/2021/ND-CP and the maintenance process of the equipment installation supplier;
- Vehicle load checking stations, payment transaction stations for road vehicles of road construction investment projects for business, traffic monitoring and management systems and other works. Other auxiliary works of the road: management, operation and maintenance of construction items must be appropriate to each type and level of the construction item.
2. Pilot some specific policies on investment in road construction
As prescribed atResolution 106/2023/QH15 pilot regulations on a number of specific policies on investment in road construction for projects mentioned in the Appendix attached to Resolution 106/2023/QH15 as follows:
Percentage of state capital participating in investment projects according to the public-private partnership method:
Allowing the ratio of state capital participating in investment projects under the public-private partnership method to exceed 50% of the total investment for 02 projects as prescribed in Appendix I attached to Resolution 106/2023/QH15 .
Agency in charge of road project investment:
- The Prime Minister considers, decides and is responsible for assigning the Provincial People's Committee to be the governing body and to use local budget and other legal capital to invest in national highway projects. Expressway for 07 projects in Appendix II attached to Resolution 106/2023/QH15
For 06 projects that do not have enough investment procedures in Appendix II, the Provincial People's Committee is assigned to be the managing agency responsible for completing investment procedures during the time this Resolution takes effect.
- The Prime Minister considers, decides and is responsible for assigning a Provincial People's Committee to be the governing body and to use this local budget to support other localities in carrying out investment activities. Project success through localities for 14 projects in Appendix III attached to this Resolution.
For 05 projects that do not have enough investment procedures in Appendix III, the Provincial People's Committee is assigned to be the managing agency responsible for completing investment procedures during the time this Resolution takes effect.
- The Provincial People's Committee is assigned to be the managing agency to carry out public investment activities of the project according to regulations for locally managed projects according to the provisions of law on public investment, construction and relevant laws; Responsible for management, exploitation and maintenance of road routes during the investment process of upgrading and expanding.
The resolution clearly states that the Government, ministries, central agencies and localities promote responsibilities, especially the responsibilities of leaders in leading and directing the implementation of prescribed contents and policies. In this Resolution, ensure publicity, transparency, efficiency, feasibility and progress; Do not allow policy profiteering, loss or waste.
The Government is fully responsible for the project list in the Appendix attached to this Resolution, ensuring that it meets the principles and criteria proposed by the Government.
3. Classification of road traffic works
Classification of traffic works is regulated by Decree 06/2021/ND-CP on quality management and maintenance of construction works, specifically as follows:
Structural works in the form of bridges, roads, tunnels or other types of structures (an independent structure or a combination of structures) used as facilities, utilities, and structures that directly serve transportation ; regulate and coordinate transportation activities; include:
- Road works: Expressway; highways; urban roads; rural roads.
- Ferry terminal, bus station; road vehicle registration facility; charging station; rest stop station.
- Railway works:
+ High-speed railway, high-speed railway, urban railway (elevated railway, subway/Metro); national railway; specialized railways and local railways;
+ Passenger station, cargo station; deport station; Barrier structures and traffic signs.
Note: Construction works for manufacturing and building new railway vehicles (locomotives, carriages) belong to the category of works serving industrial production - Section II of this Appendix.
- Bridge works: Road bridges, pedestrian bridges (not including residential suspension bridges); rail bridge; pontoon bridge; People's suspension bridge.
- Tunnel works: Subway tunnels, car tunnels, railway tunnels, pedestrian tunnels.
- Inland waterway and maritime works:
+ Inland waterway works: Ports and inland wharves; ferry terminals and ship locks; inland waterway vehicle repair works (piers, docks, slopes, platforms, raised platforms,...); waterway channels (on rivers, lakes, bays and roads to islands, on canals); anchorage areas; correction works (current direction/shore protection).
+ Maritime works: Berths, seaports; ferry terminal; dock; Ship repair works (docks, docks, ramps, platforms, raised platforms,...); maritime channels; anchorage areas and structures; Management works (breakwaters/sand barriers, current embankments/shore protection).
+ Other inland waterway and maritime works: Navigation buoy systems on rivers and at sea; Lighthouse; target post; Correctional works, breakwaters, sand protection dikes, stream direction embankments, shore protection embankments; maritime traffic monitoring and coordination system (VTS) and other maritime structures.
- Aviation works: Flight area (including flight assurance works); Passenger terminal, cargo terminal, aircraft technical area (hangar), cargo warehouse,...
- Cable car route and station to transport people and goods.
- Dry port.
- Other works such as weighing stations, culverts, tanks, trenches, tunnels, technical tunnels and other structures serving transportation.
