Procedures for applying for a license to act as a petroleum retail agent
1. Conditions for being granted a Certificate of eligibility to act as a petroleum retail agent
Traders who meet all of the following conditions will be granted a Certificate of eligibility to act as a gasoline and oil retail agent (hereinafter referred to as agent) by the Department of Industry and Trade:
- The enterprise is established according to the provisions of law, and in the Certificate of Business Registration there is registration for petroleum business.
- Own or lease a gasoline retail store with a lease term of five (05) years or more and be granted a Certificate of eligibility for gasoline retail according to the provisions of Article 25 of Decree 83/2014 /ND-CP.
- Managers and direct sales staff must be trained, trained and have training certificates, professional training in fire prevention, fire fighting and environmental protection according to current laws.
2. Documents and procedures for issuance of Certificate of eligibility to act as a petroleum retail agent
2.1. It is mandatory to apply for a Certificate of eligibility to act as a petroleum retail agent
According to the provisions of Clauses 1, 2, 3, Article 20 of Decree 83/2014/ND-CP regulating the issuance of Certificate of eligibility to act as a petroleum retail agent as follows:
- In case a trader has a system of two or more petroleum retail stores, the trader must issue a Certificate of eligibility to act as a petroleum retail agent;
- In case a trader has only one petroleum retail store owned or leased by the enterprise, he or she is not required to issue a Certificate of eligibility to act as a petroleum retail agent.
2.2. Application for issuance of Certificate of eligibility to act as a petroleum retail agent
- Application for issuance of Certificate of eligibility to act as a petroleum retail agent according to the prescribed form;
- Copy of Business Registration Certificate;
- Copies of documents proving professional training of managers and employees directly doing business as prescribed in Clause 3, Article 19 of Decree 83/2014/ND-CP;
- List of technical facilities serving petroleum business as prescribed in Clause 2, Article 19 of this Decree, accompanied by supporting documents;
- Original written confirmation of the trader providing gasoline and oil to the agent with a minimum term of one (01) year, clearly stating the type of gasoline and oil.
2.3. Place to submit application for issuance of Certificate of eligibility to act as a petroleum retail agent
The trader submits an application for a Certificate of eligibility to act as a petroleum retail agent at the Department of Industry and Trade where the trader's head office is located.
2.4. Procedure for issuance of Certificate of eligibility to act as a petroleum retail agent
Step 1: The trader sends a set of documents to the competent authority.
Step 2: In case there are not enough valid documents, within seven working days from the date of receiving the trader's documents, the competent authority shall send a written request to the trader to supplement them.
Step 3: Within thirty (30) working days from receipt of valid documents, the competent authority is responsible for reviewing, evaluating and issuing a Certificate of eligibility to act as a gasoline and oil retail agent for businessman.
In case of refusal to issue a Certificate due to ineligibility, the competent authority must respond in writing and clearly state the reason.
2.5. Validity of Certificate of eligibility to act as a petroleum retail agent
- The certificate of eligibility to act as a petroleum retail agent has a validity period of five (05) years from the date of new issue.
- When the Certificate of eligibility to act as a petroleum retail agent expires, the trader must prepare documents as in section (2.4) and send them to the competent authority thirty (30) days in advance, before The certificate is no longer valid.
