1. Procedures for granting international road transport licenses between Vietnam and Laos

Procedures for granting and re-issuing international road transport licenses between Vietnam and Laos are implemented according to the provisions of Article 23 of Decree 119/2021/ND-CP. As follows:

Object:The international road transport license between Vietnam and Laos issued to Vietnamese transport business units meets the provisions of Article 19 of the Protocol to implement the Agreement on Facilitation of Road Motor Vehicles. border crossing between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic.

Profile components:

a) Application for issuance or re-issuance of an international road transport license between Vietnam and Laos according to Form No. 01 Appendix IV of this Decree;

b) Transport business plan according to Form No. 02, Appendix IV of this Decree.

Authority to issue licenses: Vietnam Road Administration, Department of Transport, Department of Transport - Construction of provinces and centrally run cities.

Procedures:

a) The transport business unit submits 01 set of application dossier for issuance or re-issuance of an international road transport license between Vietnam and Laos to one of the competent licensing agencies mentioned in Clause 3 of this Article. in one of the following forms: in person, online, by post;

b) The licensing authority receives and checks the dossier. For applications submitted directly to the licensing authority or by post, the application receiving officer updates application information into the online public service system of the licensing authority. permission. In case the dossier needs to be amended or supplemented, the licensing authority shall notify the transport business unit directly or in writing or via the online public service system within 01 working day. from the date of receipt of the application;

c) Within 02 working days from the date of receipt of complete and valid documents as prescribed, the licensing authority shall issue the International Road Transport License between Vietnam and Laos according to Form No. 03 Appendix IV of this Decree. In case of non-issue, notification must be made in writing or via the online public service system and clearly stating the reason;

d) Return of results is done at the headquarters of the licensing authority or by post or online according to regulations.

In case the international road transport license between Vietnam and Laos is damaged or lost, the transport business unit shall prepare a dossier to request re-issuance of the license according to the above order.

2. Revoke the International Road Transport License between Vietnam and Laos

According to the provisions of Article 24 of Decree 119/2021/ND-CP, the licensing agency revokes the international road transport license between Vietnam and Laos when the transport business unit violates one of the following cases: after:

a) Doing business in a type of transport that does not comply with the International Road Transport License between Vietnam and Laos;

b) The car transport business license is revoked by a competent authority;

c) The specialized state management agency at the border gate requests revocation due to violations related to immigration and import-export activities at the border gate, regulations on management of activities at the border gate area. password;

d) Terminate operations according to the provisions of law.

Procedures:

a) The licensing agency issues a decision to revoke the international road transport license between Vietnam and Laos and sends it to the transport business unit, state management agencies at the border gate and other agencies. relevant information and post information on the website of the licensing agency;

b) After the decision to revoke the license takes effect, the transport business unit must stop all cross-border transport activities and within 15 working days must submit the documents to the licensing agency. following: International road transport license between Vietnam and Laos, all intermodal transport licenses between Vietnam and Laos have been granted.

3. Procedure cIntermodal transport license between Vietnam and Laos

The issuance and re-issuance of intermodal licenses between Vietnam and Laos are carried out in accordance with the provisions of Article 25 of Decree 119/2021/ND-CP. As follows:

Object:

Intermodal licenses between Vietnam and Laos are issued to vehicles of organizations and individuals that meet the conditions prescribed by law on road transport activities between Vietnam and Laos and the provisions of the Decree. Letter to implement the Agreement to create favorable conditions for road motor vehicles to cross the border between Vietnam and Laos.

Components of a dossier requesting issuance or re-issuance of a license for commercial vehicles include:

a) Application for issuance or re-issuance of license according to Form No. 04, Appendix IV of this Decree;

b) A copy of the Car Registration Certificate or a copy of the appointment letter to receive the Car Registration Certificate from the registration agency or a copy from the original book of the Car Registration Certificate. In case the vehicle is not owned by the transport business unit, an additional copy of one of the following documents must be presented: Written vehicle rental contract with an organization or individual or service contract between a city or city. members and cooperatives or business cooperation contracts;

c) A copy of the route operation notification document, vehicle replacement document or vehicle addition document of the route management agency and the contract to pick up and drop off passengers at bus stations in Vietnam and bus stations or other places. Pick up and drop off passengers in Laos (for vehicles operating fixed passenger transport routes between Vietnam and Laos).

Components of application dossier for issuance or re-issuance of licenses for non-commercial vehicles and vehicles serving projects, projects or business activities of enterprises in Laos:

a) Application for issuance or re-issuance of license according to Form No. 05, Appendix IV of this Decree;

b) Copy of the automobile registration certificate under the ownership of the organization or individual;

c) Copy of the decision to send on business trips from the competent authority (in the case of official vehicles and vehicles of diplomatic agencies and international organizations on business trips);

d) A copy of the contract or documents proving that the unit is carrying out works, projects or business activities in Laos (for businesses and cooperatives serving works, projects or activities). doing business in Laos territory).

Licensing authority:

a) The Directorate for Roads of Vietnam issues intermodal licenses between Vietnam and Laos for vehicles of agencies of the Party, the National Assembly, the Government, ministries, ministerial-level agencies, agencies under ministries, and other agencies. Central political and social organizations, diplomatic agencies, representative agencies of international organizations in Vietnam; Other agencies, organizations and individuals who need to apply for issuance at Vietnam Road Administration;

b) Department of Transport, Department of Transport - Construction of provinces and centrally run cities grant intermodal licenses between Vietnam and Laos for vehicles of agencies, organizations, individuals, and units. transportation business in the local area;

c) The local Department of Transport where the border gate with Laos is located grants licenses to non-commercial vehicles of organizations and individuals located in other provinces of Vietnam to pass through the local border gate. own way of management.

Procedures:

a) Organizations, individuals, and transportation business units submit 01 set of documents to the licensing authority. The agency competent to issue licenses receives and inspects documents. For applications submitted directly to the licensing authority or by post, the officer receiving the application updates information into the online public service system of the licensing authority. In case the dossier needs to be amended or supplemented, the licensing authority shall notify directly or in writing or notify via the online public service system to organizations, individuals, and transportation business units. b) Within 02 working days from the date of receipt of complete and valid documents as prescribed, the licensing authority shall issue the intermodal license between Vietnam and Laos according to Form No. 06, Appendix IV of This Decree. In case of refusal, the competent authority issuing the license shall notify in writing or via the online public service system and clearly state the reason;

c) Return of results is done at the headquarters of the licensing authority or by post or online according to regulations.

When the intermodal license between Vietnam and Laos expires or is damaged or lost; Organizations, individuals, and transport business units prepare dossiers to request re-issuance according to the provisions of Clauses 2, 3 and 5 of this Article.

4. Revoke the intermodal license between Vietnam and Laos

According to the provisions of Article 26 of Decree 119/2021/ND-CP, the licensing agency revokes the Intermodal License between Vietnam and Laos when there is a violation in one of the following cases:

a) Failure to comply with the contents stated in the intermodal license when conducting intermodal transport activities between Vietnam and Laos;

b) The car transport business license or international road transport license between Vietnam and Laos is revoked by a competent authority;

c) Vehicles past the deadline for re-importation into Vietnam according to regulations, except in cases of natural disasters, accidents or force majeure reasons.

Procedures:

a) The licensing agency shall issue a decision to revoke the intermodal license between Vietnam and Laos and send it to organizations, individuals, transport business units, state management agencies at the border gates and other relevant agencies. Relevant agencies simultaneously post information on the licensing agency's website;

b) After the decision to revoke the license takes effect, the transport business unit must stop cross-border transport activities for the vehicle whose license has been revoked and within 15 working days must submit the relevant license. transportation between Vietnam and Laos of that vehicle to the licensing agency.
