What are the conditions for granting a license to provide pay radio and television services?
Based on Clause 1, Article 12, Decree No. 06/2016/ND-CP regulates that businesses that want to be granted a license to provide pay radio and television services must meet the following conditions:
(1) Is a Vietnamese enterprise. For enterprises with foreign investment capital, the Prime Minister's policy approval must be obtained;
(2) Have a service provision plan consistent with the radio and television service development planning, radio and television transmission transmission planning and other plans in the field of radio and television. electronic information;
(3) Have a license to establish a telecommunications network or have an agreement to rent and use a telecommunications network that meets technical requirements to transmit services to subscribers connected to that telecommunications network for prescribed services. at the Points a, b, c andPoint d Clause 1 Article 4 Decree No. 06/2016/ND-CP;
Have confirmation of registration of domain name ".vn" or identified Internet address to provide services to subscribers for the services specified in Point dd Clause 1 Article 4 Decree No. 06/2016/ND-CP;
(4) There are options: Arranging human resources; investment in technical equipment; service market forecast and analysis; business plan and service prices, investment cost estimates and operating costs for at least the first 2 (two) years; Documents proving charter capital or documents of equivalent value that meet the requirements for service provision according to estimates;
(5) Have a plan to establish a transmission center for all domestic and foreign program channels concentrated in one location, except for program channels in the list of program channels serving political tasks , essential local propaganda information, including:
Technical design of signal processing equipment systems, equipment connecting to transmission networks, service management equipment, subscription management and content protection;
(6) Have a plan to apply modern technology in accordance with State regulations on standards and technical regulations to ensure service quality and information security; Timely handle technical problems to ensure service continuity and subscribers' rights;
(7) Have a proposed list of domestic program channels (except for the program channels specified in Clause 4 Article 13 Decree No. 06/2016/ND-CP), foreign program channels, on-demand content, and value-added content will be provided on pay radio and television services with written approval from the content provider;
(8) There is a written agreement on appropriate signal reception points for program channels as prescribed in Point c Clause 1 Article 14 Decree No. 06/2016/ND-CP, modified by Point a Clause 6 Article 1 Decree No. 71/2022/ND-CP (Effective from January 1, 20230).
