This is the penalty level specified in the Decree No. 16/2022/ND-CP January 28, 2022 on handling administrative violations in construction.

Specifically, Clause 7, Article 16 of this Decree stipulates penalties for organizing the construction of works without a construction permit but according to regulations, a construction permit is required as follows:

- Fine from VND 60.000.000 - 80.000.000 for construction of individual houses.

- Fine from VND 80.000.000 - 100.000.000 for building individual houses in conservation areas, historical - cultural relics or other construction works.

- Fine from VND 120.000.000 - 140.000.000 for construction projects requiring construction investment feasibility study reports or projects requiring construction investment technical and economic reports.

The above fines apply to organizations. For the same administrative violation, the fine for individuals is equal to 1/2 of the fine for organizations.

According to Article 81 of this Decree, if the above cases are eligible for construction permits and are under construction, they will be handled as follows:

- Competent persons are responsible for making records of administrative violations and requesting organizations and individuals committing violations to stop construction.

- Within 90 days for construction investment projects, 30 days for individual houses from the date of issuance of the decision to sanction administrative violations, the organization or individual committing the violation must complete the Application for construction permit or construction permit.

- At the end of the above time limit, if the violating organization or individual does not present the issued construction permit or the adjusted construction permit or the adjusted construction design that has been appraised, the competent person will issue a written sanction. Notice requesting violating organizations and individuals to self-destroy the violating construction works or parts of construction works.

This Decree takes effect from January 28, 2022.
