Pursuant to the provisions of Article 15 of Decree 06/2021/ND-CP, the responsibilities of workers on construction sites include:

Accordingly, the responsibilities of employees in ensuring occupational safety and hygiene at the workplace are stipulated in Article 17 of the 2015 Law on Occupational Safety and Hygiene, specifically:
+ Responsible for complying with regulations, rules as well as procedures and requirements on occupational safety and hygiene issued by the employer or competent State agency related to work assigned tasks.
+ Comply with legal regulations and master knowledge and skills on measures to ensure occupational safety and hygiene in the workplace.
+ For the provided personal protective equipment, safety and occupational hygiene equipment at the workplace during the performance of assigned work and tasks, the employee is responsible for Use according to regulations and preservation.
+ Before using machines, equipment, supplies and substances with strict requirements on safety and labor hygiene, you must participate in safety and labor hygiene training.
+ In cases where there is a direct risk of loss of safety and labor hygiene or violations of regulations on safety, hygiene and labor at the workplace, you must be responsible for preventing that risk. .
+ When there is a labor accident, incident or a risk of an incident, labor accident or occupational disease is discovered, the employee is responsible for promptly reporting it to the responsible person.
+ Be responsible for proactively participating in rescuing and overcoming incidents and occupational accidents according to the incident handling plan, emergency response or when ordered by the employer or a competent state agency .
– When detecting a risk of unsafe labor during the construction process, you must be responsible for reporting it to the competent person.
– For assigned jobs that do not ensure labor safety or are not adequately provided with personal protective equipment according to regulations, they must be refused.
– Workers are only allowed to perform jobs with strict requirements on safety and occupational hygiene after being trained and issued with a safety and occupational hygiene card.
– When an occupational accident occurs or an incident causes unsafe work, you must participate in rescue and recovery.
– Responsible for implementing other contents based on legal regulations on occupational safety and hygiene.
2. Some other regulations on labor safety in construction:
Labor safety in construction is understood as a solution to prevent and combat impacts with dangerous and harmful factors with the aim of not affecting the health, injury and life of workers. human. At the same time, prevent incidents that cause loss of labor safety when carrying out construction work.
In addition to regulating the responsibilities of workers at construction sites, the law also specifically stipulates the responsibilities of construction contractors as well as investors to ensure labor safety in construction. As follows:
2.1. Responsibilities of construction contractors:
According to the provisions of Article 13 of Decree 06/2021/ND-CP, construction contractors have the following responsibilities:
– Receiving and managing construction sites, preserving location markers and boundary markers of construction sites, and managing construction sites in accordance with regulations.
– Prepare and notify the investor and other entities related to the contractor's construction management system.
Accordingly, the construction management system ensures compliance with the nature and scale of the project.
– Submit to the investor for approval the following contents:
+ Plan to organize experiments, inspections, inspections, tests, trial runs, monitoring and measuring technical parameters of the project according to design requirements and technical instructions.
+ Construction progress of the project.
+ Measures to check and control the quality of materials, products, components, and equipment used for the project.
+ Construction methods.
+ Plan for inspection and acceptance of construction work, acceptance of construction stages or parts (items) of construction works, acceptance of completed construction items and construction works.
+ Comprehensive safety plans according to prescribed contents.
+ Detailed safety measures for jobs with high risk of labor insecurity have been identified in the comprehensive safety plan.
+ Other contents based on investor's request.
– Responsibility for identifying dangerous areas during construction work.
– According to the provisions of the construction contract as well as the provisions of law, arrange human resources and construction equipment.
– For the work that you perform, organize the implementation of a general plan on labor safety.
– Carry out the responsibilities of the contractor in the procurement, fabrication, production of materials, components or products and equipment used for the project.
– Before and during construction, according to the requirements of the design and regulations of the construction contract, it is necessary to organize the implementation of experiments, inspections, tests, and inspections of materials and components, construction products, construction equipment, technological equipment.
– When detecting errors, quality defects or construction incidents, construction work must be stopped for construction work, parts and construction items. At the same time, fix these errors, defects, and problems.
– Carry out surveying and monitoring of works according to design requirements.
– Responsibility for inspecting construction work for tasks performed by subcontractors.
– Use labor safety costs in construction for the right purpose.
– For progress, quality, volume, labor safety and environmental sanitation of construction work, reports must be made to the investor.
– For the work you perform, you must organize and store construction management records.
2.2. Responsibilities of the investor:
– Conduct selection of individuals and organizations that meet the capacity conditions on the basis of provisions of law for the purpose of carrying out construction works.
– Hand over the site to the construction contractor in accordance with the construction progress and regulations of the construction contract.
– Carry out construction supervision according to prescribed content.
– For individuals in the investor's construction management system, establish a construction management system and notify about the duties and powers of each subject.
– Arrange enough appropriate human resources to carry out construction supervision and safety management in construction.
– Carry out inspection and approval of overall construction progress as well as details of project items.
– In case there is a volume arising according to the provisions of the construction contract, check and confirm.
– Make reports on safety measures to specialized construction agencies.
– Organize acceptance of construction projects.
– Organize preparation of documents for completion of construction works.
– In case it is considered that the quality of construction does not meet technical requirements, construction methods are not safe, or violate regulations on labor safety management, causing or at risk of an accident occurring. If an occupational accident or incident causes unsafe work, the construction contractor must temporarily stop or suspend construction.
