1. What conditions are required to apply for a license to operate an overweight vehicle?
According to Clause 1, Article 9 of the Circular No. 46/2015/TT-BGTVT, overweight vehicles are vehicles whose total vehicle weight or axle load exceeds the published road operating load.
In cases where it is necessary to transport non-detachable goods or to circulate vehicles with a total weight exceeding the load capacity, before putting the vehicle into traffic, the vehicle owner, transport hirer or vehicle driver must Request the competent authority to issue a Vehicle Circulation License.
Pursuant to Clause 1, Article 20 of this Circular, overweight vehicles will only be granted a Marketing Permit when they fall into one of the following cases:
1 - Special case.
2 - In case there is no other transportation option
3 - In cases where it is not possible to use other types of means of transport suitable for road transport.
2. Where to apply for a license to operate overweight vehicles?
According to Article 22 of Circular No. 46/2015/TT-BGTVT, the authority to issue licenses to operate overweight vehicles belongs to the following individuals:
- Director of the Department of Transport, Director of Road Management Department: Issue vehicle circulation licenses nationwide.
- Minister of Transport: Granting vehicle circulation licenses in special cases serving security, national defense, energy projects, natural disaster prevention and search and rescue.
Therefore, depending on the situation, individuals and organizations wishing to apply for a license to operate overweight vehicles can go to the Department of Transport or the Road Management Department or the Ministry of Transport.
