To do seafood export business, in addition to a seafood export license, do I need a CITES license?
According to Point 2 Official Dispatch No. 5665/TCHQ-GSQL 2021 Instructions on exported seafood are as follows:
2. For exported seafood
- Aquatic species listed in the Appendix of CITES exported for commercial purposes must have a CITES license as prescribed in Decree No. 06/2019/ND-CP and Decree No. 84/2021/ND-CP.
- Strictly control aquatic species on the List of aquatic species banned from export and the List of species permitted for conditional export. Cases in the above List of exports for scientific research and international cooperation purposes must have a license issued by the Ministry of Agriculture and Rural Development according to regulations.
Thus, depending on the type of exported aquatic products, if the exported aquatic products fall under the list of "List of aquatic species banned from export, List of aquatic species subject to conditional export" promulgated in Decree No. 26/2019/ND-CP. You must apply for a license to export aquatic species according to regulations.
In case the exported aquatic species belongs to the aquatic species in the CITES Appendix and is exported for commercial purposes, an additional CITES permit is required for export.
